Last updated: 5 March 2026
1. Introduction
These Terms of Service ("Terms") govern your use of the Clear Claims website and services. By submitting a claim, using our AI assistant, or accessing any part of our website, you agree to these Terms. If you do not agree, please do not use our services.
2. About Our Services
Clear Claims provides claims management services for road traffic accidents, including but not limited to:
- Managing your insurance claim from start to settlement
- Arranging credit hire vehicles at no upfront cost
- Coordinating vehicle repairs with approved garages
- Referring personal injury claims to qualified solicitors
- Providing an AI-powered assistant to answer your questions
We operate on a no win, no fee basis unless otherwise agreed in writing.
3. Eligibility
To use our services, you must be at least 18 years of age and have the legal authority to enter into a binding agreement. If you are submitting a claim on behalf of someone else, you must have their authorisation to do so.
4. Your Obligations
When using our services, you agree to:
- Provide accurate and truthful information in your claim submission
- Respond promptly to requests for additional information or documents
- Not submit fraudulent, misleading, or exaggerated claims
- Inform us of any changes to your circumstances that may affect your claim
- Not attempt to interfere with or damage our website or systems
Important: Submitting a fraudulent claim is a criminal offence under the Fraud Act 2006 and may result in prosecution.
5. Claim Submission
When you submit a claim through our website, you will receive a unique reference number (format: CC-YYYY-XXXXX). This is not a guarantee that your claim will be accepted or successful. All claims are subject to review and assessment.
We reserve the right to decline any claim that:
- Falls outside the scope of our services
- Contains false or misleading information
- Relates to an incident that does not qualify as a valid road traffic accident claim
6. Documents and Evidence
You may be asked to upload documents such as photographs, driving licences, insurance certificates, vehicle logbooks, and dashcam footage. By uploading these documents, you confirm that:
- They are genuine and unaltered
- You have the right to share them with us
- We may share them with relevant third parties (insurers, solicitors, repair companies) as necessary to process your claim
Uploaded files must not exceed 50MB per file. Accepted formats include JPEG, PNG, WebP, HEIC, PDF, MP4, and MOV.
7. AI Claim Assistant
Our AI-powered claim assistant is provided for informational purposes only. While we strive for accuracy, the AI assistant:
- Does not constitute legal advice
- May occasionally provide inaccurate or incomplete information
- Should not be relied upon as a substitute for professional legal or insurance guidance
If in doubt, please contact us directly by phone or email.
8. Fees and Costs
Our default operating model is no win, no fee. This means:
- You will not be charged any upfront fees for our services
- If your claim is unsuccessful, you will not owe us anything
- If your claim is successful, our fees will be recovered from the at-fault party's insurer — not from your settlement
Any exceptions to this arrangement will be clearly communicated and agreed in writing before work commences.
9. Limitation of Liability
To the maximum extent permitted by law:
- We do not guarantee the outcome of any claim
- We are not liable for any delays caused by third parties (insurers, solicitors, repair companies)
- We are not liable for any loss arising from inaccurate information you provide
- Our total liability shall not exceed the amount recovered on your behalf
Nothing in these Terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
10. Intellectual Property
All content on the Clear Claims website — including text, design, logos, graphics, and software — is owned by or licensed to Clear Claims and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or modify any content without our written permission.
11. Termination
You may withdraw your claim at any time by contacting us. We reserve the right to cease working on your claim if:
- You fail to cooperate or provide requested information
- We discover that false information has been provided
- The claim is no longer viable in our professional assessment
12. Complaints
